BETA CURBSY PRIVACY POLICY
Curbsy’s Privacy Policy (“Privacy Policy”) describes the information we collect through our mobile application and how we use it. The terms “we,” “us,” and “our” refer to Curbsy. “You” refers to you, as a user of the Curbsy application. By accepting our Privacy Policy and Terms of Use (found here: http://www.westlatakeaway.com/beta/eula.html), you consent to our collection, use, storage, and disclosure of your information as described in this Privacy Policy.
We collect information from and about you and your device. Personal Information is information that you voluntarily provide to us and is personally identifiable, such as your name and email address. “Non-Personal Information” is information that we collect from the mobile device or other equipment which you use to interact with Curbsy, as explained below. We collect various forms of information, including the following:
- Account Information
To use Curbsy’s application, users must register a profile on Curbsy, through which we collect Personal Information that users voluntarily provide through the registration process. To register, users must connect through one of two social networking sites (“SNS”) that already contains their personal information – Facebook or Twitter. Each SNS allows Curbsy to access varied information, and what information you allow is affected by the privacy settings you establish at the SNS. The information you allow Curbsy to access varies by SNS platform, and is affected by the privacy settings you establish at the SNS. For example, Curbsy may access and store some or all of the following information, as allowed by you, the SNS, and your preferences:
- your first and last name
- Facebook or Twitter Username
- your profile pictures or the URL associated with your profile picture
- the login email you provided to that SNS when you registered
- your gender
- your birthday
- your interests and activities
Once you have registered a profile, you may voluntarily add additional personal information to that profile to enhance your use of Curbsy’s services, including credit card information to facilitate ordering transactions, vehicle information and vehicle photographs to facilitate curbside pick up of orders, and addresses for billing purposes and to facilitate delivery orders.
- Location Information
Curbsy’s services are best provided to users who provide their location. If you tell us where you are by allowing your mobile device to send us your location, we may store and use that information to provide you with location-based services. Note: Curbsy will share your location with restaurants you order curbside pickup from so that they can have your order ready when you arrive. If you want to deactivate this feature you can deactivate GPS on your mobile device.
- Public content.
Users can contribute to Curbsy in a number of different ways, including adding or verifying restaurants, uploading photos, adding items to menus, and creating their own personalized favorite items for other users to see and order. We may store these contributions (your "Public Content"), display them to other users, and use them for promotional purposes. - Unique Device Identifier
In addition to the personal information you voluntarily provide when you register, as well as your location information, in an effort to improve the quality of Curbsy’s service, we track information provided to us by your devices unique identifier (UDID). This information is used to track how users are interacting with our app in the aggregate, and we do no transmit user activity data obtained through UDID tracking to any third parties.
Use of Personal Information:
In addition to using the Personal Information you provide to us to deliver Curbsy services, we use the information to enhance your experience with Curbsy. Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent, or otherwise share for marketing purposes the Personal Information that we collect with third parties without your consent. We do share Personal Information with vendors who are performing services on behalf of Curbsy. For example, we provide your personal information, such as your address, location, credit card information, and phone number to the restaurants you order from. We also provide your credit card information to our merchant account vendor for storage and management, so that users can keep cards on file to use in future orders if they elect to do so. Those vendors are required by contract to only use your Personal Information at our direction and in accordance with our Privacy Policy.
Use of Non-Personal Information
In general, we use Non-Personal Information to help us improve Curbsy services and customize users’ experiences. We also aggregate Non-Personal Information to use in statistical analysis to allow us to track trends and analyze patterns in the use of Curbsy. This Privacy Policy does not limit our use or disclosure of any Non-Personal Information in any way. We reserve the right to use and disclose such Non-Personal Information to our partners, advertisers, and other third parties at our discretion.
Business Transfers
In the event of a business transition such as a merger, acquisition by another company, or sale of all or a portion of Curbsy’s assets, users’ Personal Information may be among the assets transferred. You acknowledge and consent that such transfers are permitted by this Privacy Policy, and that any acquirer of ours or that acquirer’s assets may continue to process your Personal Information as set forth in this Privacy Policy.
We strive hard to protect your information from unauthorized access. Your Curbsy account is protected by the password you create to access your profile, and we also add an additional password to protect any credit card information you choose to keep in our application to help prevent unauthorized use. We urge you to take steps to keep your Personal Information (including your password) safe.
We also take precautions against security breaches of our customer databases by putting in place technological security measures, including encryption, firewalls, and secure socket layer technology. Specifically, Curbsy user data is stored in distinct encrypted databases, separate from all other data in the Curbsy data system. It is kept behind our vendor’s state of the art firewalls and security gateways.
However, this is not a guarantee that your information may not be accessed, disclosed, altered, or destroyed by breach of such firewalls and secure server software. By using our application, you acknowledge that you understand and agree to assume these risks.
You have a right at any time to stop us from contacting you for marketing purposes. If you receive promotional communications from us, you will be able to indicate a preference to stop receiving further promotional communications from us and will have the opportunity to "opt-out" by following the unsubscribe instructions provided in the promotional e-mail.
Please note that despite any indicated email marketing preferences, we may send you administrative emails regarding Curbsy, including, for example, notices of updates to our Privacy Policy if we choose to provide such notices to you in this manner.
We may revise our Privacy Policy and our Terms of Service at any time. We will notify you about significant changes to our policy by sending a notice to users via email, or by placing a notice upon entry to our application, so that you can choose whether to continue using our service. Non material changes or clarifications will take effect immediately; significant changes will go into effect 30 days after we notify. You should periodically check this privacy policy for updates.
